1. Scope of Work
Mono Studio agrees to provide content creation services including but not limited to:
The scope of each project will be detailed in a written proposal or brief, agreed to by both parties. Any changes to the scope after agreement must be approved in writing and may incur additional fees.
2. Project Start
The project will begin when Mono Studio confirms receipt of the client’s products. This will be timestamped via email confirmation. The standard turnaround time is approximately 2 weeks for up to 12 images, unless otherwise specified in the proposal.
To ensure quality, the Client agrees to provide products in a presentable and accurate condition, consistent with the brand’s materials. This includes correct packaging, label positioning, size, and color. Mono Studio is not liable for damage or discrepancies unless due to gross negligence while the product is in our care.
After delivery of the initial draft or completed images, the Client will have 30 days to approve or request changes. If no response is received within 30 days, the assets will be deemed approved by default, and the project will be considered closed.
Once assets are approved (explicitly or by default), no further revisions, retouching, or reshoots will be permitted unless separately agreed upon in writing.
The number of included revisions will be outlined in the proposal. Additional revisions beyond this scope may incur further charges. Revision requests must be submitted within 7 business days of asset delivery.
A non-refundable deposit of 50% is required to secure Mono Studio’s services. The remaining 50% is due upon project completion and prior to the release of final deliverables.
Invoices are due within 7 days of receipt. Late payments may incur a fee of 2.5% per month of the outstanding amount.
If the Client cancels the project after confirmation, the deposit will not be refunded. No refund will be issued after delivery of final images or video content.
Either party may terminate the agreement at any time with written notice. In such a case, the Client is responsible for payment of any work completed and reimbursable expenses incurred. If Mono Studio cancels the project, any unused portion of the deposit will be refunded.
Mono Studio will treat all client information, materials, and brand concepts as confidential. Likewise, concepts, storyboards, and proposals shared by Mono Studio must not be disclosed or reused without written permission.
Mono Studio retains full ownership of all original working files, including RAW images, project files, and concepts.
Upon full payment, the Client is granted a license to use the final deliverables for the agreed-upon purposes (e.g., e-commerce, social media, advertising). Any additional usage beyond this scope must be discussed and licensed separately.
Mono Studio reserves the right to showcase completed work in its portfolio, website, and social media channels unless otherwise agreed in writing.
Mono Studio’s liability for any claim related to services rendered shall not exceed the total amount paid by the Client for that project.
Mono Studio shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits or business interruptions.
Neither party shall be held liable for delays or failure to perform due to events outside their reasonable control, including natural disasters, government restrictions, labor strikes, or equipment failure.
The Client agrees to indemnify and hold Mono Studio harmless from any claims, damages, or liabilities arising from the Client’s use of the deliverables or violation of these Terms.
This agreement is governed by the laws of New Zealand. Any disputes will be resolved in the courts of Auckland, New Zealand.
These Terms represent the full understanding between Mono Studio and the Client and supersede any prior discussions or agreements, written or oral.
No waiver of any term or condition of this agreement shall be deemed a further or continuing waiver of such term or any other term. Any waiver must be in writing and signed by both parties.
